won't hear DuPont Forest lawsuit
March 5, 2003 Associated Press Hendersonville, North Carolina - The state Supreme Court has declined to review a lawsuit filed by three businessmen over the state's seizure of the DuPont State Forest. The court's decision may be the end of efforts to overturn North Carolina's forced sale of the 22 hundred acre tract. South Carolina developer Jim Anthony had planned to build a gated community of upscale homes on the land, home to three waterfalls. But North Carolina used its power of eminent domain to buy the land in the fall of 2000. Three businessmen sued in May 2001. They said the state violated the constitution when it used more than $12 million from the N.C. Clean Water Management Trust Fund to buy the property. Copyright 2003 Associated Press |
