Terri Schiavo: Urgent Update

December 18, 2003

Thank you for caring about Terri.

Case update:

Regarding Schiavo v Bush, the case to determine the constitutionality of Terris Law (the law that allowed Floridas Governor to order the return of Terris sustenance), Judge W. Douglas Baird allowed a continuance until Tuesday, December 23, 2003.

At that time, Judge Baird may decide to allow a full trial -- or [he may] issue a summary ruling without a trial.

At the moment, Governor Bush and his legal team are not being permitted to call witnesses or present evidence that might support their case.

Judge Baird has stated unofficially that Terri's Law is not constitutional.

Action Items:

Floridas State Attorney for Pinellas County, Bernie McCabe

Mr. McCabe has refused to investigate allegations of abuse, neglect and exploitation against Terri by her guardian. These are serious crimes under Florida law -- and they require full investigation.

You can read an excellent comprehensive outline of the related statutes here:

You can sign an online petition to Mr. McCabe demanding that he investigate here:

You may contact Mr. McCabe:

Governor Bush

The Florida Constitution, Article IV, Section 1, states, "The governor shall take care that the laws be faithfully executed," and, "The governor shall have power to call out the militia to ... execute the laws of the state."

Gov. Bush's Amicus Brief filed on behalf of Terri Schiavo:

The judge [that is] ordering her death -- not only by removal of her feeding tube, but [also] by ordering no food or fluid be given her by mouth -- constitutes "the deliberate killing of a human being by starvation and dehydration [which] is prohibited by the right to life enshrined in [both] the Florida and federal Constitutions."

Terri can swallow. Her videos show she does not drool. Therefore, she is swallowing her saliva.

HEIDI LAW, CNA, under oath, stated, "On three or four occasions I personally fed Terri small mouthfuls of Jello, which she was able to swallow and enjoyed immensely. I did not do it more often only because I was so afraid of being caught by Michael."

On her 40th birthday, December 3, 2003, Terri was not allowed even a tiny amount of birthday cake. She was not even allowed to wear lip gloss.

On October 19, 2003, when she was dying of starvation and dehydration, Monsignor Thaddeus Malanowski, her priest, sought to give her the Sacrament of Anointing of the Sick or the Viaticum, the last communion for a Catholic before death.

The police would not allow him to give her even a morsel of moistened communion wafer

We need to encourage Governor Bush to use his authority to enforce the constitutional and legislated laws. He must stop this judicial collusion to deliberately kill Terri. He has the authority to do this. He needs your encouragement.

Please forward this to friends who would care, not only about saving an innocent woman's life, but also about the horrific precedent that this case would set.

Thank you again for your interest in the well-being of Terri Schindler-Schiavo and for supporting those who work for her safety and human rights.
