Takings Litigation - U.S. Stay Motion Denied

Judge Sypolt in the U.S. Court of Federal Claims today denied the U.S. motion to stay Klamath Irrigation District et al. vs. The United States. The court agreed that this case will not be delayed until the end of the adjudication process, as recommended by federal attorneys.

The hearing lasted over 2 hours -- Klamath Project representatives present in the courtroom emphasized the important contributions made by attorneys representing Klamath irrigators -- including Bill Ganong, Roger Marzulla, and Paul Simmons.

The case is now moving ahead -- a motion for summary judgment on the issue of liability will be filed by Roger Marzulla within 60 days.
