Miami, Florida - An alleged serial rapist who escaped from jail using tied-together bedsheets for a rope also had sawlike tools that may have been smuggled in, police said Thursday.

"This is a conspiracy. This was hatched over about three months," Miami police Chief John Timoney told the Associated Press.

Timoney said the escapee, Reynaldo E. Rapalo, 34, and another inmate used tools to escape Tuesday night that apparently were smuggled into the Turner Guilford Knight Correctional Center -- "tools you can't purchase from the prison commissary."

Charles J. McRay, director of the Miami-Dade Corrections Department, put two corrections officers on paid administrative leave Thursday: one assigned to patrol the facility's perimeter and one assigned to the maximum-security unit where Rapalo and others accused of sex crimes lived.

McRay answered "absolutely not" when asked by the AP if there were allegations that the officers were involved in the escape.

McRay also ordered all vents at the Knight jail welded shut and that lighting be improved.

Rapalo and Idanio Bravo, 38, climbed through a vent in the 7-foot ceiling of Bravo's sixth-floor cell to reach the roof, after someone pried off the vent's locked door. Bars blocking the opening onto the roof also were cut, apparently by some type of saw, investigators said.

The escape was first discovered by a visitor who noticed the chain of bedsheets hanging down the side of the jail. The visitor told officials he saw an inmate scale down the sheets -- moments after a security van drove by.

There are indications that someone planned to meet Rapalo after he escaped, Timoney said.

The Florida Department of Law Enforcement said Rapalo is considered armed and dangerous, possibly carrying a small-caliber handgun. He was dressed in black when he escaped, according to the witness, and left his jail uniform behind.

Bravo, who was also awaiting trial on sexual assault charges, broke his ankles when he jumped and was captured outside the jail. He was being questioned.

Rapalo, a native of Honduras, is accused of sexually assaulting seven girls and women, ranging from 11 to 79 years old, in the Shenandoah and Little Havana neighborhoods in 2002 and 2003. Arrested in late 2003, he was awaiting a February trial.

Prosecutors have said DNA matches him to the seven rapes -- as well as four attempted assaults.

Federal, state and local officials have offered a combined $16,000 reward for anyone who can lead them to his recapture.

Mr. Speaker, I rise on the floor of the House today to share, sadly, yet another tragic story of another instance where senseless criminal acts, acts that could have been prevented and should have never happened, were allowed to take place because of our badly broken immigration system.
     
Mr. Speaker, for the last year, South Florida has been terrorized by a serial rapist.
 
Beginning in September of last year, seven females in the Miami area, ranging between the ages of 11 and 79, have been victimized by a vicious, brutal criminal.
 
Needless to say, the year-long attacks have left most women who live in the Miami area fearing for their safety and on guard for these past 12 months.
     
Thankfully, the local law enforcement authorities in the area believe they now have their man.
 
Earlier this month, Miami police arrested Reynaldo Rapalo.
 
A citizen of Honduras, he is accused of raping the seven women I mentioned earlier, and trying to attack and rape four others during that same time.
     
The Miami police indicate that they have Mr. Rapalo's fingerprints, his DNA that links him to these dastardly crimes, and finally his confession.
 
Tragically, Mr. Speaker, they also had Mr. Rapalo himself back in October of last year, before six of the rapes had been allowed to occur.
 
He was arrested on molestation charges, and at the time Mr. Rapalo's C1 visa had expired.
 
He was living here then illegally.
     
Mr. Speaker, had the CLEAR Act been on the books last October, Reynaldo Rapalo would have been detained and deportation proceedings would have begun and, more importantly, the women who were subsequently brutally attacked would have never fallen victim.

Clear Law Enforcement for Criminal Alien Removal Act of 2003 or the CLEAR Act of 2003 - States that: (1) State and local law enforcement personnel are fully authorized to investigate, apprehend, or remove aliens in the United States (including interstate transportation of such aliens to detention centers) in the enforcement of U.S. immigration laws; and (2) a State that does not have a statute permitting enforcement of Federal immigration laws within two years of enactment of this Act shall not receive certain Federal incarceration assistance.

Amends the Immigration and Nationality Act with respect to illegal aliens to: (1) establish criminal penalties and forfeiture for aliens unlawfully present in the United States; (2) increase specified criminal and civil penalties for illegal entry and failure to depart violations; and (3) provide for payment of funds from certain civil penalties to State and local law enforcement agencies for apprehension of such aliens.

Provides for the listing of immigration violators in the National Crime Information Center database.

Requires States and localities to provide the Department of Homeland Security with specified information about apprehended illegal aliens. Eliminates certain Federal incarceration assistance for noncompliance.

Directs the Attorney General to make grants to local police agencies for equipment and facilities related to housing and processing illegal aliens.

Amends the Act to provide for Federal custody and State or local compensation of State or locally apprehended illegal aliens.

Establishes a process for State and local claims against the Federal Government for failure to cooperate in enforcing immigration laws.

Directs the Secretary or the Attorney General to establish immigration-related training for State and local personnel.

Provides: (1) personal liability immunity for Federal, State, or local personnel enforcing immigration laws within the scope of their duties; and (2) civil rights money damage immunity for Federal, State, or local agencies enforcing immigration laws unless their personnel violated criminal law in such enforcement.

States that the Department of Justice and the Department of Homeland Security shall continue to operate the Institutional Removal Program, which shall be expanded to all States.

LIN: You're about to hear live on two developing stories this hour. On the left, any moment we're going to hear from Michael Bloomberg, the mayor of New York City, on what's going to happen in the transit strike and the millions of people who are left stranded by it.

And on the right, a news conference by the Miami police on an alleged rapist, an accused rapist who is on the loose. He escaped from jail, and now police are protecting some of his victims.

In the meantime, we want to give you the background on this story. This rapist has been in jail -- or this alleged rapist, excuse me, has been in jail for the last two years. He's been on the loose now, he is a suspected serial rapist, and there is a massive manhunt under way in Florida. He escaped from a Miami jail last night, and police say he is armed and dangerous.

Gary Nelson from affiliate WFOR has that story.

GARY NELSON, REPORTER, WFOR (voice over): Jail guards survey the walls of Miami-Dade's TGK lockup last night, examined some of the bed sheets and blankets used in an escape like something out of a bad movie. Reynaldo Rapalo -- the so-called "Shenandoah Rapist" who terrorized Miami for more than a year until his arrest two years ago -- broke out of the jail last night using knotted-together sheets to scale down at least four stories.

UNIDENTIFIED MALE: He was our number one priority from September of 2002 to September of 2003. Eleven-year-old children to 79-year-old women, 11 victims in that time period within a small area of our city. We have to find this guy.

NELSON: Rapalo escaped while a fellow inmate, Idanio Bravo, also a sex offender, wasn't so lucky. He fell and broke both ankles. A dragnet is out now for Rapalo.

UNIDENTIFIED MALE: We're checking all avenues of the state: the airport, bus terminals, train stations. A lot of operational things I can't talk about, but they are in place.

NELSON: It's thought Rapalo may be packing a .22 caliber pistol. No word on how he might have gotten that here. Also, no word on why the escape went undetected for 40 minutes, despite the numerous security cameras all around this jail building.

And Rapalo is reported to have been wearing all black. No word either on how he managed to shed his orange jailhouse jumpsuit.

LIN: All right. So once again, we're waiting to hear from the Miami police as to what they're doing to find this accused rapist. We understand they have officers standing by at the victims' homes in case he tries to go back to the scene of the crime.

A woman who was twice beaten and raped in her East Naples home died this week and now authorities say they are pursuing murder charges against the man [Illegal Alien] arrested in connection with her sexual assault.

The 69-year-old woman, who is not being identified by the Naples Daily News because of the nature of the crime, died Monday after being hospitalized earlier in February.

A determination has not yet been made whether the injuries the woman received during the attacks, one on January 24 and one a week later on January 31, contributed to her death. She was hospitalized on February 6 for treatment of a condition that may [have been] related to her injuries.

Mario Roberto Trejo-Rosales, 29, who lists his address only as off Bayshore Drive in East Naples, was arrested February 1 and charged with twice raping a woman inside her Bayshore Drive area home.

Trejo-Rosales is an illegal immigrant [ALIEN] from Honduras.

Deputies had set up surveillance on her home and Trejo-Rosales returned for a third time to the woman's house.

The Collier County Sheriff's Office, the county Medical Examiner's Office and the State Attorney's Office are investigating the case to determine whether he can be charged in connection with her death.

"The crimes perpetrated against this victim were atrocious and violent," a release from the Sheriff's Office states. "The Collier County Sheriff's Office is pursuing this investigation as a homicide and will be relentless in that pursuit."

The charges could range from manslaughter to first-degree murder, sheriff's officials say.

The woman identified Trejo-Rosales as her rapist in a lineup and had given sheriff's investigators a statement about her attacks before she died, said sheriff's spokeswoman Sheri Mausen. Deputies had also collected lab evidence in the case, she said.

The woman identified her attacker as soon as she saw him in a lineup, saying she "will never be able to forget his face," according to arrest reports.

Investigators say Trejo-Rosales broke into the woman's home on January 24 and again and early January 31. The woman didn't report the first rape until she went to a doctor and he reported it to authorities.

On January 24 around 10 p.m., deputies say Trejo-Rosales forced his way into the woman's home. She said she thought it might [have been] her grandson who often [visited] her, but when she saw that it wasn't him, she tried to close the door. Trejo-Rosales grabbed her by the arms and pushed her into the house. He then raped her. She tried to "play dead" and remained motionless until he left. He stole three rings and three necklaces valued at $1,500, investigators said.

In the second attack, which happened January 31 around 2 a.m., the woman told authorities she had been watching television when Trejo-Rosales forced open the sliding glass door, threw the woman to the ground and raped her. She said he smelled of alcohol and spoke to her in Spanish. Once he said, "I love you" in English.

On February 1, armed with night vision goggles and videotaping equipment that could capture images at night, deputies caught Trejo-Rosales at the house. Deputies watched him go inside and they could see him standing in the living room from their surveillance perch. After a brief struggle, Trejo-Rosales was arrested.

Trejo-Rosales, who is being held without bond at the county jail, was arrested on six counts of sexual battery with serious injury, which are felonies that could mean a life sentence if he's convicted. He was charged with three sexual acts in each rape. He is also charged with battery on a law enforcement officer, burglary of an occupied dwelling, resisting arrest with violence, grand theft, home invasion robbery, and burglary with battery. The latter charge is also punishable by a life sentence.

Sheriff Don Hunter has described the attacks as brutal and said the second attack was "even more brutal" than the first. The woman was beaten during the assaults and items from her home, including some jewelry, were stolen, investigators say.

In an e-mail to the Daily News, the woman's family said they do not wish to talk about the case.

"Right now we do not wish to speak to anyone, but perhaps in time we will consider it," an e-mail from the victim's granddaughter says. "Please respect our wishes and let us grieve in peace."
